Bankruptcy filing – Filing bankruptcy petition case officially begins when you file your petition with the bankruptcy court. Your bankruptcy petition may be dismissed if filed improperly and incomplete. It is advisable to make sure that your petition is complete and organized before filing.

341 Meeting – approx. 45 Days After Filing – The court will hold a Meeting of Creditors approximately 4 to 6 weeks after your bankruptcy petition is filed. You must attend this meeting with your social security number and your drivers license number. This meeting will include your creditors, the bankruptcy trustee, and your bankruptcy lawyer.

8 Years Before Filing Chapter 7 Bankruptcy – You must wait 8 years to file a Chapter 7 bankruptcy case if you have already received a discharge from a prior Chapter 7. The idea here is to prevent abuse of the bankruptcy process. Debtors are thus limited to the number of times that they can file bankruptcy petition. Chapter 13 Bankruptcy Payment Period – 3 to 5 Years After Filing – A debtor will receive a formal discharge from the bankruptcy court approximately 3 to 5 years after the date of your first payment based on your Chapter 13 repayment plan. Upon bankruptcy discharge, qualified debts will be discharged and you will not have to pay them again to the creditors.

180 Days Before Filing – A debtor must undergo training from a certified credit counseling agency in order to be eligible to file for bankruptcy. This credit counseling certificate expires after 180 days from the date issued. One must attend two required credit counseling courses.

90 Days State Resident Requirement Before Filing – A debtor must be a resident in the state in which you are filing for a minimum of 90 days. This will prevent individuals from moving to a different sate for the sole purpose of filing bankruptcy.

15 Days After Filing – It is advisable to have a complete file before filing bankruptcy. However, you have approximately 15 days after filing for bankruptcy to provide the court with specific information about assets, expenses, liabilities, and income.

Government agencies Claim -180 Days After Filing – Government agencies like taxes owed to IRS that have claims against you have 180 days after the date of filing your petition to submit proof of their claims against you to the bankruptcy court. Current taxes due owed to IRS may not be discharged in bankruptcy.
